Overview:

Domestic Partnership is a relationship between two individuals; who live together or share their domestic life but are not joined by traditional marriage or civil union. Many jurisdictions do not accept legitimacy of domestic partnerships, but trend for accepting them as legal is on the move now.

In some jurisdictions, such as California, has got equal status as civil unions or legally accepted same sex or different sex unions. Since the concept of domestic partnership is not much old for U.S society, as this terminology was first used in 1982, the idea of domestic partnership is still a developing concept.

The level of rights and responsibilities varies widely from state to state. In some states where the domestic partnerships are not legally equal to the common law marriage, it may offer legal protection for domestic partnership agreements. History:


The term "Domestic Partner" was first used in a lawsuit, filed in San Francisco by a Human Rights Commission employee Larry Brinkin, in 1982. He filed this lawsuit because he was denied three days bereavement leave, given to married employees, at the loss of his eleven years partner. The judge agreed with his employer’s claim only because there was no way to know if his relationship was legitimate.


Legal Status of Domestic Partners:


In United States, domestic partnership is a matter of your state, city or employer’s recognition or accepted status that may or may not be available to couples having same-sex or opposite-sex.

Domestic Partnerships lacks recognition from Federal Government, as it does not award any of the 1138 rights that are offered to married couples. Domestic partnership recognition varies state to state and there is no nationwide uniformity in rights, responsibilities and benefits awarded to domestic partners. Local jurisdiction or state recognition of domestic partners generally have more worth to protect benefits as awarded under Family Medical Leave Act. Domestic partners generally enjoy more rights in San Francisco, New York City, and Washington, D.C as compared to other cities and states in U.S.


Possible Legal conflicts:


There are many serious legal concerns about the status of domestic partnership, which arise from the difference in state and federal laws regarding domestic partners. Federal Laws under DOMA (Defense of Marriage Act) do not extend recognition to those partnerships. Hence, domestic partners are denied to social security benefits and they are not considered as spouses for the purpose of any Federal tax law.


Benefits:


Partners may get some benefits like health insurance from private or some public employers. But they have to pay taxes in return for these benefits. Partner benefits are common among large employers but the status of partners varies from employer to employer.
